Why does Rod Rosenstein think HE has the right to choose the next SCOTUS justice?


The Left and its accompanying Deep State continue to do all they can to undermine POTUS Donald Trump and his efforts to Make America Great Again, and it appears they are attempting to interfere with his nomination of federal appeals court Judge Brett Kavanaugh’s nomination to the Supreme Court.

A few days after the president announced Kavanaugh as his pick to replace retiring Associate Justice Anthony Kennedy, Deputy Attorney General Rod Rosenstein — whom some believe is really running the Justice Department, not AG Jeff Sessions — sent an unusual request to all 93 U.S. attorneys around the country.

Rosenstein asked them to task at least three federal prosecutors to help the Justice Department review government records and rulings regarding Kavanaugh in a move so out of the ordinary that even The New York Times called it “an unusual insertion of politics into federal law enforcement.”

The paper noted:

While the Justice Department has helped work on previous Supreme Court nominations, department lawyers in Washington typically carry out that task, not prosecutors who pursue criminal investigations nationwide.

Does Rod Rosenstein somehow think he has the right to name the next Supreme Court justice? Because it sure looks that way.

The Times reported further that Rosenstein sent an email to the U.S. attorneys asking for up to three prosecutors “who can make this important project a priority for the next several weeks.” He further instructed the U.S. attorneys to forward the prosecutors’ names to him by the middle of last week.

Kavanaugh has a long history of public service and rulings from the bench. He currently sits on the U.S. Circuit Court of Appeals for the D.C. Circuit, the one that hears most cases involving the federal bureaucracy’s rules and regulations. Before then, he worked for Independent Counsel Kenneth Starr as he investigated President Bill Clinton in the 1990s, on the 2000 Florida presidential election recount, and as a White House aide to President George W. Bush.

‘It’s flat-out wrong’

That, and he’s purported to be an originalist when it comes to interpreting laws. Like the other originalists on the high court — Justices Samuel Alito and Clarence Thomas — Kavanaugh’s basic question is, “Does this law violate the Constitution?” That’s what all SCOTUS justices should ask but the court’s “liberals” are judicial activists who seek to legislate from the bench instead.

That’s likely why Kavanaugh is now being targeted by the Deep State, and Rosenstein just proved that he’s part of it.

As the Times noted, Rosenstein’s email contained the subject line “Personal Message to U.S. Attorneys from the Deputy A.G.,” and included this sentence, “We need your help in connection with President Trump’s nomination of Judge Brett Kavanaugh to serve on the Supreme Court.” (Related: As Left explodes over Trump SCOTUS pick Kavanaugh, let’s remember that unqualified Elena Kagan was put on the court by Obama for reliable liberal vote.)

The paper said former law enforcement officials said it’s blatantly improper for Rosenstein to have sent that request — which really wasn’t a ‘request.’

“It’s flat-out wrong to have career federal prosecutors engaged in a political process like the vetting of a Supreme Court nominee,” Christopher Hunter, a former FBI agent and federal prosecutor who is currently running for Congress. “It takes them away from the mission they’re supposed to be fulfilling, which is effective criminal justice enforcement.”

He added that he could not remember ever being similarly tasked when he was serving.

Justice Dept. spokeswoman Sarah Isgur Flores said that federal prosecutors have been asked to vet Supreme Court nominees in the past. But Rosenstein’s is the first broad request to U.S. attorneys. 

Which, once again, begs the question: Where in the world is Jeff Sessions? This request by Rosenstein has nothing at all to do with the “Russian collusion” nonsense he recused himself from.

If he doesn’t want to be, or can’t be the attorney general, he needs to go away. Meantime, POTUS should call Rosenstein in and have him explain just what it is he’s doing — and why.
